Terms and Conditions

All services and products supplied by Premier Image Services (“the company”) to customers are governed by the following general terms and conditions, which cancel out any previous terms and conditions of business.

All orders are accepted on the understanding that customers accept these terms and conditions. The risk in products (“the goods”) the company supplies shall pass to the customer on delivery. Title to the goods shall not pass to the customer until the company has received payment in full for the goods. Until the title to the goods has passed to the customer, the customer shall hold the goods on a fiduciary basis as the company’s bailee but may resell or use the goods in the ordinary course of its business.

Credit Accounts

All accounts are to be paid by direct debit, which will be collected weekly 30 days from invoice, unless an alternative has been agreed in writing. Where payment is not made on time, the company reserves the right to charge interest at a rate of 8% above base.

Prices

The price payable by the customer will be in accordance with the company price ruling at the time of acceptance of the order. The company reserves the right to alter the prices without notice. The prices on the order system will be correct at the time of ordering.

Image Copyright

It is a criminal offence under the Copyright Designs and Patents Act 1988 to knowingly infringe copyright. It is the customer’s responsibility to ensure that all material supplied to the Company for processing, copying or reproduction is free from any third-party claim of infringement or claim of copyright.

Orders are only accepted on the clear understanding that:

• The customer owns the copyright or that the work is out of copyright.
• The customer has the copyright owner’s written consent. In this case the written

consent must accompany the order and work supplied. The customer indemnifies the company against all costs, claims, damages and losses of whatsoever nature arising from any action or claim brought by a third party in respect of alleged infringement of copyright.

Trade Descriptions Act

The size of frames/prints in the price list and on the ordering system are approximate only and may be over or under the quoted size.

Delivery

All orders will be dispatched by a suitable carrier or delivery system at the discretion of the company.

The company shall not be liable for any damage to, discrepancies in or shortages/delay of delivered materials/goods unless notified by the customer within 48 hours of delivery.

Single orders over the value of £50.00 will be subject to free delivery, single orders under the value of £50.00 will be subject to a delivery charge. The delivery charge may vary.

Display Goods

Display products and samples will be provided to the customer by the company at a discounted rate, the discounted display rate is only applicable if the customer’s account reaches a minimum of £5000.00 in the previous 12 months. The discounted display rate is variable dependent upon the product, not all products are available at a discounted rate. Chromaluxe products are not available at a discounted rate.

Liability

All reasonable care is taken with materials sent to the company for processing or printing. The company’s liability for service failure, loss of or damage to photographic processing or printing shall be limited to a refund of the company’s charges for processing or printing and their replacement with unused material.

Insurance

Where the value of an order/service or material sent for processing is valued at more than the company liability, it is advised that the customer provides their own insurance.

Chromaluxe

Images files submitted for Chromaluxe products must be 100% correct prior to submission. File submission requirements will be advised, editing/manipulation must be correct. Once the image is printed/pressed it is irreversible and will be subject to the full product cost. Imperfections in the metal are natural and to be expected.

Orders submitted

Orders placed, are to be per customer, not per product. Multiple products for the same customer, should be placed on one order to avoid an administration charge of £5.00.
